Morning Talk 2019- Enhancing Corporate Governance by Imposing Legal Liabilities “Act & Resign”

FIABCI Malaysia’s monthly Morning Talk is one of the networking activities for members and non-members to interact and update the industry information regularly. It is held every first Wednesday of the month and open free-of-charge to members. Various topics and subjects have been discussed and shared in our Morning Talk since year 2007.

Topic: Enhancing Corporate Governance by Imposing Legal Liabilities “Act & Resign”

Speaker’s Profile: SAC Mohd Nur Lokman Head of Private Sector Branch, Community Education Division, Malaysian Anti-Corruption Commission

SAC Mohd Nur Lokman is currently the Head, Private Sector Branch, Community Education Division for Malaysian Anti-Corruption Commission since 2014. He graduated from IIUM in Bachelor’s Degree in Law. Currently, SAC Mohd Nur Lokman also served as the member for CIDB working group for CIDB Integrity Modules for Contractors and as a Lecture in UKM for Integrity and Corruption subject. He is currently the Head, Private Sector Branch, Community Education Division for Malaysian Anti-Corruption Commission since 2014.

He is a member for Working Group for The National Centre for Governance, Integrity and Anti-Corruption (“GIACC”) – UNDP Anti-Bribery Management System Certification Project for Ministries, State Government and Local Authority in Malaysia. He has presented several papers on Anti-Corruption at Regional and recently he has been invited by the Government of Thailand to conduct training on Anti-Corruption for public sector in Thailand. He is also having vast experience as an investigator and a prosecuting officer.

Content of The Topic: 

The Malaysian Anti-Corruption Commission (Amendment) Act 2018 has been passed in Parliament and gazetted on 4th May 2018. The main thrust of this Act is to introduce a new far- reaching corporate liability provision (the “Provision”) into the MACC Act. The Malaysian Anti-Corruption Commission will enforce the new provision effective from June 2020.

The MACC (Amendment) Act 2018 introduces a new Section 17A into the MACC Act. This section provides that “a commercial organisation commits an offence if any person associated with the commercial organisation commits a corrupt act in order to obtain or retain business or advantage for the commercial organisation”.
